To illustrate the current situation in medical malpractice litigation, we can consider two cases that occurred in Krasnodar and Stavropol.

Krasnodar

The woman filed a lawsuit in Krasnodar city court against the hospital to recover the cost of the reconstructive operation and compensation for moral damage. In support, she indicated that the hospital doctor performed mechanical tumescent liposuction on her inner and outer thighs. In total for procedures, medications, etc. the patient paid 114,000 rubles. However, after the operations, her appearance noticeably deteriorated.

In addition, her health condition worsened: the temperature rose, inflammation of the left thigh arose, looseness of subcutaneous fat in the thighs, legs, ankle joints, diffuse granularity, and deformation of the relief in the middle third and lower third of the right thigh along the outer surface were observed. On the left thigh, a “cake-like mass” had accumulated under the skin.

The operation was carried out not in a specially equipped operating room, but in a dressing room without the participation of an anesthesiologist. At the patient's request, the hospital doctor performed a repeat operation on the left hip. As a result of repeated injections, a deep, loose hole formed on the thigh. Despite the fact that the woman performed all the procedures prescribed to her, there were no positive results from the operation.

Under these circumstances, the court found the claims for damages from the hospital to be satisfied. Taking into account that liposuction was performed improperly, which caused asymmetry and deformation of the contour of the hips, the presence of a pronounced bifurcated subgluteal fold of the right hip of the plaintiff in accordance with Article 151 of the Civil Code of the Russian Federation and Article 15 of the Federal Law “On the Protection of Consumer Rights,” the plaintiff has the right to compensation moral damage.

When determining the amount of compensation for moral damage, the court. Taking into account the improper provision of medical services, the nature of the moral suffering caused to the plaintiff associated with its consequences, the location, her age, as well as a special attitude towards her appearance, as evidenced by the performance of cosmetic operations, taking into account the requirements of reasonableness and fairness, believes to establish it at 8 000 rubles.

Taking into account the satisfaction of the claim, in accordance with Article 98 of the Code of Civil Procedure of the Russian Federation, the plaintiff’s legal expenses for payment of the cost of the examination in the amount of 32,534 rubles are subject to reimbursement by the hospital.

Guided by Articles 194-198 of the Code of Civil Procedure of the Russian Federation, the court decided to recover from the hospital in favor of the victim 362,500 rubles in damages, compensation for moral damage in the amount of 8,000 rubles, and 32,534 rubles in compensation for legal expenses for the examination, and a total of 403,034 rubles.

Stavropol

The woman appealed to the court of the city of Stavropol and filed a claim against the LLC for damages and compensation for moral damage. In support of the stated demands, the plaintiff explained at the court hearing that she contacted the LLC for the purpose of consultation and plastic surgery: blepharoplasty - elimination of excess skin of the upper eyelids. I was dissatisfied with the results of the operation, as there were visible scars on the eyelids, which from an aesthetic point of view did not look correct.

After some time, the woman returned to the LLC, as she was promised to have eyelid correction, and at the same time she wanted to have breast suture correction (2-sided), knee liposuction and fat injection into the hands, excision of excess tissue of the labia minora, gold threads and hyaluronic injection acid on lips.

These operations were carried out in accordance with the contract for the provision of medical services. All operations were performed for aesthetic reasons, except for the excision of excess tissue of the MPG, which was dictated by the interests of the patient’s health.

The woman was dissatisfied with the results of the operation; after the introduction of gold threads, her face became deformed, and her appearance became deplorable. Due to the fact that she works with clients in the aesthetic field, the consequences of this operation had a serious impact on her psyche. The operation to excise excess MPG tissue was performed poorly; instead of correcting the MPG, which was dictated by physiological problems, the MPG were completely excised.

The postoperative days were painful, the stitches were constantly felt, the threads injured the vagina. Instead of a professional operation, the doctor disfigured her and his actions led to tragic consequences for the woman; she lost her health, became disfigured and lost functions that were important for a woman.

The plaintiff asked the court to recover 15,000,000 rubles in compensation for moral damage. To recover monetary compensation in the amount of 59,000 rubles as compensation for damage, to recover the costs of conducting an examination, and the costs of providing assistance to a lawyer.

Under these circumstances, the court found that the paid medical service was provided improperly, and therefore the victim rightfully demands compensation for damage and a refund of the cost of the operation of 28,200 rubles.

Guided by Articles 194-198 of the Code of Civil Procedure of the Russian Federation and taking into account the specific circumstances of the case, the court considered it possible to recover in favor of the plaintiff compensation for moral damage in the amount of 100,000 rubles, taking into account the satisfaction of the claim and in accordance with Article 98 of the Code of Civil Procedure of the Russian Federation, the plaintiff’s legal expenses for paying for the examination in the amount of 51 900 rubles, expenses for legal assistance in the amount of 30,000 rubles, and a total of 210,100 rubles.

Correcting the eyelids
